• AI setup and automation, such as AI assistants, automated replies, follow-ups, and workflow automations
• Basic security checkups, such as password and two-factor authentication setup, backup checks, and staff phishing-awareness training
• Online presence services, such as website setup or updates and Google Business Profile optimization
• Ongoing monthly support for the above

The specific scope of each engagement is confirmed in writing before work begins. Our security checkups address common security basics and are not penetration tests, compliance audits, or guarantees against breaches. Our services do not guarantee specific business results, such as revenue, rankings, or reviews. We do not provide legal, accounting, or compliance advice.

4. Your Responsibilities

To deliver our services, we may need access to your business accounts and systems. You agree to:

• Grant only the access needed for the approved work, and only for accounts you are authorized to share
• Provide accurate information about your business and systems
• Review and approve customer-facing content and automations before they go live
• Change shared passwords once a project is complete, if we recommend it

5. Acceptable Use

You agree not to use our website or services to:

• Violate any applicable law or regulation
• Infringe the rights of any third party, including privacy, publicity, or intellectual property rights
• Submit content or information you are not authorized to share
• Introduce malware, viruses, or other harmful code
• Harass, abuse, or harm another person or entity

6. Your Content and Data

You remain the owner of your business content and data. By providing content or access to us, you grant KYON a limited, non-exclusive license to use, process, and store it solely as necessary to deliver the services you have requested, in accordance with our Privacy Policy. Websites, automations, and other work we set up for you belong to you once paid for, excluding third-party software, which remains subject to its provider's terms.

7. Intellectual Property

All rights, title, and interest in and to the KYON website, branding, logos, and content (excluding your content) are owned by KYON or its licensors. You may not use any KYON trademarks, logos, or branding without our prior written consent.

8. Payments and Billing

• You agree to pay all applicable fees as described at the time of purchase or in your written scope.
• Setup fees are one-time charges. Monthly support is billed in advance each month until canceled.
• Third-party software, domain, or hosting costs are passed through at cost and discussed with you beforehand.

Our Refund Policy explains when refunds may be available. We may change our pricing from time to time and will notify existing clients of changes in advance.

9. Third-Party Services

Our services often involve third-party tools and platforms, such as AI providers, website hosts, password managers, and Google. We do not control, and are not responsible for, the availability, changes, content, or privacy practices of these third parties. Your use of them is subject to their own terms and policies.

10. Disclaimers

To the fullest extent permitted by law:

• Our services are provided on an “as is” and “as available” basis.
• We do not guarantee that any system will be uninterrupted, error-free, or completely secure, or that our work will prevent all cyberattacks or data loss.
• AI tools can make mistakes. You are responsible for reviewing AI-generated content and responses used in your business.

Nothing in our services or communications constitutes legal, financial, or professional compliance advice.

11. Limitation of Liability

To the maximum extent permitted by law, KYON and its officers, employees, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or goodwill
• Any damages arising out of or related to your use of, or inability to use, the services

In any case, KYON’s total liability for all claims relating to the services shall not exceed the amount you paid to us during the twelve (12) months prior to the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless KYON and its officers, employees, and affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the services, your content, your violation of these Terms, or your violation of any law or third-party rights.

We may suspend or terminate services if you violate these Terms, if your use poses a risk to us or others, or if required by law.
